The following terms and conditions apply to the use of BetterCare Link platform and its Subsidiaries. In using the BetterCare Link platform, you implicitly agree to said terms and conditions.
BetterCare Link platform enables an easy and efficient way for its users to access all the products and services it offers.
This platform and related services are provided subject to your compliance with the terms and conditions set forth below (“Terms and Conditions”). Please read the following information carefully. Any deviations from these terms and conditions are only binding if accepted in writing by BetterCare Link platform.
The PRIVACY POLICY is expressly incorporated in these Terms and Conditions.

All other trademarks, service marks and logos used in this platform are the trademarks, service marks or logos of their respective owners.
IMPORTANT NOTE for anyone under the age of 18. No one under the age of 18 may use the services of BetterCare Link platform except under the supervision of a parent or legal guardian who agrees to be bound by these Terms and Conditions.
In addition, BetterCare Link platform will not accept any personal information, including communications in any form, from anyone under the age of 13. Ask your parents or legal guardians to contact us if they wish to obtain services on your behalf.
Our platform is free to use but some areas require registration or subscription to use. Once registration is complete, you can immediately access those areas.
You must avoid sharing your username and password to prevent unauthorized access to your account. Passwords in particular must be kept strictly confidential. BetterCare Link operates based on the assumption that all account activity after registration is under the direction and supervision of the account holder. You are therefore liable for all said activity, unless you have reported third-party knowledge of your password to BetterCare Link.
BetterCare Link makes no representations whatsoever about any other platform that you may access through this site. When you access other platforms or platform through links or pointers, please understand that it is independent from BetterCare Link, and that BetterCare Link has no control over the content on that platform. In addition, a hyperlink inside BetterCare Link does not mean that BetterCare Link endorses or accepts any responsibility for the content, or the use, of the linked site. It is up to you to take precautions to ensure that whatever you select for your use or download is free of such items as viruses, worms, Trojan horses, and other items of a destructive nature.
Using BetterCare Link for actions that contravene any applicable laws and regulations is forbidden. This includes, among other things, using the service to store and distribute information that is libelous, defamatory, or racist or posting the same on its community forum.
It is also forbidden to use BetterCare Link to share or distribute Materials that:

If BetterCare Link finds that a user has violated the above conditions or receives a complaint alleging such, BetterCare Link may intervene to curb said violation.
If BetterCare Link believes that the continued functioning of the computer systems or network operated by BetterCare Link or third parties is actually or under threat of being damaged or jeopardized, for example due to excessive transmission of data, leaks of personal data or virus activity, BetterCare Link may take any and all steps it deems reasonably necessary to stop or avert such damage or jeopardy.
BetterCare Link reserves the right to file a criminal complaint for any offenses committed through or using its service.
BetterCare Link reserves the right to recover any damages incurred as a result of a violation of these terms of use. You hereby indemnify BetterCare Link against any third-party claims relating to damages incurred as a result of a violation of these terms of use.
No explicit maximums apply to content, storage space, or data traffic unless otherwise agreed. If the Customer or partner company engages in frequent excessive use, BetterCare Link will contact the Customer to reach a suitable arrangement.
As a condition of your use of this platform, you warrant to BetterCare Link that you will not use the platform and its subsidiaries and services for any purpose that is unlawful or prohibited by these Terms and Conditions.
BetterCare Link will endeavor at all times to provide high-quality and uninterrupted availability. However, BetterCare Link cannot offer any guarantees regarding quality or availability.
It is possible that the platform could include inaccuracies or errors, and that unauthorized additions, deletions and alterations could be made to the platform functionality by third parties.
If an inaccuracy arises, please inform BetterCare Link so that it can be corrected.
Information contained on the platform may be changed or updated without notice.
BetterCare Link actively maintains the BetterCare Link service. If maintenance is expected to result in a limitation of availability, BetterCare Link will carry out said maintenance when use of the service is low. Maintenance is announced in advance where possible. Maintenance in connection with emergencies may be carried out at any time without prior notice.
BetterCare Link may on occasion adjust BetterCare Link’s functionalities. While user feedback and suggestions are welcome, BetterCare Link ultimately decides which changes will be made and which will not. It is possible that said changes may affect the functioning of your products.
In some cases, BetterCare Link may process your customers' personal data. To further regulate the division of roles and associated obligations, provisions are laid out in these terms and conditions.
BetterCare Link and associated software, as well as all information and images stored on the platform are protected by the intellectual property rights of BetterCare Link and may not be copied or used in any way without separate written permission from BetterCare Link, except when and to the extent permitted by mandatory law.
Information stored or processed by you via the service is and remains your property (or that of your customer).
If you send information to BetterCare Link, e.g. a bug report or suggestion for improvement, you grant BetterCare Link a perpetual and unlimited license to use this information for its service. This does not apply to information you explicitly mark as confidential.
All pages within this platform and any material made available for download (collectively the “platforms”) are the property of BetterCare Link (referred to as “BetterCare Link platform” in this Agreement) and/or its affiliates. The platform is protected by federal and international copyright and trademark laws. No portion of the materials on these pages may be reprinted, republished, modified, or distributed in any form without the express written permission of BetterCare Link platform. You shall keep intact any proprietary notices, including copyright notices, contained on any downloaded materials and shall comply with any applicable end user license agreements. Any rights not expressly granted by these Terms and Conditions or any applicable end user license agreements are reserved by BetterCare Link.
Purchase of a paid BetterCare Link products, programs and Subscription that is subject to a monthly or annual payment, are always due at the start of this period, while monthly fees are collected automatically unless otherwise agreed.
Unless explicitly otherwise stated, all prices stipulated by BetterCare Link are exclusive of tax, handling and packing including shipping and delivery and any other government-imposed levies.
Payments can be manually transferred to BetterCare Link’s bank account, via credit card, PayPal, or in accordance with the payment instructions on the platform.
Because the service is delivered directly and at your explicit request, canceling a payment by invoking the Distance Selling Act is not possible.
BetterCare Link will invoice the Customer electronically for amounts owed by the Customer.
The Customer must pay the invoice within 14 days of the invoice date, unless otherwise agreed in writing.
If the Customer has failed to pay an invoice in full after 14 days following the invoice date, the Customer will automatically be in default with no notice of such required.
If the Customer is in default, any subscription or products hosted for the Customer may be made inaccessible until the overdue amounts have been paid.
This platform, including any content or information contained within it or any platform-related service, provided “as is,” with all faults, with no representations or warranties or any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You assume total responsibility and risk for your use of this platform, related services, and hyperlinked platform.
BetterCare Link and its subsidiaries and affiliates are neither responsible or liable for any direct, indirect incidental, consequential, special, exemplary, punitive, or other damages arising out of or relating in any way to the platform. platform related services, content or information contained within the platform, and/or any hyperlinked platform. Your sole remedy for dissatisfaction with the platform, related services, and/or hyperlinked platform and other platforms is to stop using the platform and/or those services.
Except in case of intentional misconduct or gross negligence, BetterCare Link’s liability is limited to the amount paid by you during the one month preceding the event giving rise to damages.
BetterCare Link is in no event liable for indirect damages, consequential damages, lost profits, lost savings, or damages due to an interruption of business operations.
Any right to compensation is only valid if damages are reported in writing to BetterCare Link within 14 days of discovery at the latest.
In case of force majeure, BetterCare Link is at no time obligated to pay compensation to the Customer for damages incurred by the Customer. Force majeure includes disruptions or failures of the internet or telecommunications infrastructure, power failures, internal riots, mobilization, war, transport blockages, strikes, exclusions, business disruptions, supply interruptions, fires, and flooding.
This agreement takes effect as soon as you use the service for the first time and will remain in effect for an indefinite period of time.
If the agreement is for BetterCare Link subscription billed annually, it will be automatically extended for a period of one year unless it has been prematurely terminated in writing by one of the two parties within the notice period of 1 month for automatic renewal.
If the agreement is for BetterCare Link subscription billed monthly, it will be automatically renewed each month unless it has been canceled in time and in writing by one of the parties. A notice period of one month applies.
Following termination of the agreement as a result of cancellation, BetterCare Link may immediately cancel the functionalities made available as part of a paid subscription. The customer may continue to use BetterCare Link free service if desired.
Consumers have the right to withdraw from their subscription agreement if requested by email within 14 days of purchase, as provided by applicable consumer protection laws. However, by registering and starting to use the free service, you acknowledge and agree that we will begin providing services immediately, and you expressly waive your right of withdrawal, in accordance with US consumer laws and other local regulations. This waiver is effective from the moment you register and account and start using free services.
Business-to-business (B2B) subscriptions are not eligible for refunds under any circumstances.
BetterCare Link reserves the right to amend these terms and conditions as well as its pricing. Any such changes will take effect in the next billing cycle (as defined in these terms and conditions).
BetterCare Link will announce any changes or additions to its service at least thirty days before said changes take effect.
If you do not wish to accept a change or addition you are free to cancel the agreement up until the date said agreement takes effect. Use of the service after the effective date implies acceptance of the amended or supplemented terms and conditions.
These Terms and Conditions are entered into in the State of Iowa in the United States of America and shall be governed by and construed in accordance with the laws of the State of Iowa, exclusive of its choice of law rules. Each party to these Terms and Conditions submits to the exclusive jurisdiction of the state and federal courts of Iowa, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. In any action to enforce these Terms and Conditions, the prevailing party will be entitled to costs and reasonable attorney fees. If any of the Terms and Conditions are held by a court or other tribunal of competent jurisdiction to be unenforceable, those provisions shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect.
These Terms and Conditions constitute the entire agreement between BetterCare Link and you pertaining to the subject matter of this Agreement. In its sole discretion, BetterCare Link may modify these Terms and Conditions by posting the revised version on this platform and you agree that each visit by you to this platform is a new transaction governed by the terms of use linked on this platform at that time.
If a provision in these terms of use proves to be invalid, this will not affect the validity of the entire terms of use. The parties will in this case add (a) new provision(s) which will shape the intention of the original provision as far as legally possible.
The current version of any communication or information stored by BetterCare Link assumes to be correct unless and until you provide proof to the contrary.
BetterCare Link reserves the right to transfer its rights and obligations under the agreement to a third party taking over BetterCare Link or the relevant business operations belonging to it.
